The object of the tender is to procure dedicated optical fibre infrastructure taking the form of multiple dark fibre spans, provided by the tenderer, between agreed pairs of termination points or routes which include housing facilities along the fibre route. The connectivity elements will be used to transport internet traffic for research and educational purposes. The lease period is expected to be 15 years (Indefeasible Right of Use - IRU) after the fibre infrastructure is delivered for use by the Contractor. In addition, fibre will be leased for interconnecting the Bulgarian National Research Network with other Research Networks in the region (Greece, Serbia, Romania). The Contractor should also provide fibre maintenance and collocation services.

Годност за упражняване на професионалната дейност:
Participation is open to all legal persons participating either individually or in a grouping (consortium) of candidates which are established in a Member State of the European Union or in a country or territory of the regions covered and/or authorised by the specific instruments applicable to the HiPERB programme under which the contract is financed, namely Albania, Bosnia and Herzegovina, the Former Yugoslav Republic of Macedonia, Montenegro and Serbia. Participation is also open to international organisations. The participation of natural persons is directly governed by the specific instruments applicable to the programme under which the contract is financed.

All eligible natural and legal persons (as per item 11 above) or groupings of such persons (consortia) may apply.
A consortium may be a permanent, legally-established grouping or a grouping which has been constituted informally for a specific tender procedure. All members of a consortium (ie, the leader and all other members) are jointly and severally liable to the Contracting Authority.

The participation of an ineligible natural or legal person (as per item 11) will result in the automatic exclusion of that person. In particular, if that ineligible person belongs to a consortium, the whole consortium will be excluded.
Икономическо и финансово състояние:
The candidate (or at least the leader of the consortium) has to attest of an operational existence of a minimum of three (3) years, including the past three years (2008, 2009, 2010);
The averages of cash and cash equivalents at the beginning and end of the year for the past three years (2008, 2009, 2010) are positive.
Минимално(и) ниво(а) на стандарти:
The average annual turnover of the candidate over the past three years (2008, 2009, 2010) must exceed 12 000 000 EUR for Lot 1, 600 000 EUR for Lot 2 and 1 000 000 EUR for Lot 3 and if the candidate applies for more than one lots, the average annual turnover should exceed the sum of the respective abovementioned figures;

Технически и професионални способности:
An economic operator may, where appropriate and for a particular contract, rely on the capacities of other entities, regardless of the legal nature of the links, which it has with them. Some examples of when it may not be considered appropriate by the Contracting Authority are when the tender rely in majority on the capacities of other entities or when they rely on key criteria. If the candidate rely on other entities, it must in that case prove to the Contracting Authority that it will have at its disposal the resources necessary for performance of the contract, for example by producing an undertaking on the part of those entities to place those resources at its disposal. Such entities, for instance the parent company of the economic operator, must respect the same rules of eligibility and notably that of nationality, as the economic operator. Furthermore, the data for this third entity for the relevant selection criterion should be included in the tender in a separate document. Proof of the capacity will also have to be furnished when requested by the Contracting Authority.

The candidate has completed successfully at least one (1) project with a budget of at least that of this contract in fields related to this contract during the following period: from 1.1.2006 till the deadline for submission of the applications; and.

Tenderers believing that they have been harmed by an error or irregularity during the award process may petition the Contracting Authority directly. The Contracting Authority must reply within 90 days of receipt of the complaint. If this procedure fails, the tenderer may have recourse to the following: Where the Government of the Hellenic Republic is not the Contracting Authority and where informed of such a complaint, it must communicate its opinion to the Contracting Authority and do all it can to facilitate an amicable solution between the complainant (tenderer) and the Contracting Authority. If this procedure fails, the tenderer may have recourse to procedures established under the recipient’s national legislation.
