1) Candidates shall be requested to send their signed and stamped requests to participate to the address of the Contracting Entity set out above in the following form: One (1) original, one (1) copy and two (2) CDs. Two (2) additional copies shall be sent as follows: a) One (1) copy to: IGI Poseidon SA, 92 Marinou Antypa Street, 14121 Iraklio Attikis, Greece. Attention: Mr. K. Karagiannakos. b) One (1) copy to: Edison SpA, 31 Foro Buonaparte Street, 20121 Milan, Italy. Attention: Mr. F. Santambrogio. 2) The Contracting Entity reserves the right not to invite to tender the Candidates who do not comply with all requirements under point III.2 (Conditions for Participation) of this Contract Notice; 3) Until expiry of the deadline for submission of requests to participate, each Candidate can amend or supplement his submission; 4) Written questions from the candidates in relation to the current Contract Notice can be sent to the indicated contact points, at the latest, ten (10) calendar days before the deadline for the submission of requests to participate; 5) The European Energy Programme for Recovery (EEPR) of the EU will co-finance part of the procurement. 6) The Contract duration as per section II.3 is indicative. An updated Contract duration shall be provided in the Invitation to Tender documents. 7) Delivery of a first quantity will be required within approximately three (3) months from the Notice by the Contracting Entity to launch production. 8) There is no other specification or additional document at this stage. Further instructions will be issued to Candidates who are selected for invitation to tender; 9) The conduct of the procurement procedure will be subject of the law of Bulgaria, where ICGB AD is established. 10) Contracting Entity may require tender evaluation criteria during Contractor selection, or specific Contract provisions from the selected supplier, in accordance with any obligations, which may be requested by international lenders to the IGB project or the competent EU institutions.

Candidates (Economic Operators), including each member of a grouping, are required to submit the following:

a) Candidate's written express of interest in participating in the current pre-qualification procedure signed by a duly authorized person.

b) Original (or notarized and apostilled) copy of a certificate of current corporate registration (certificate of good standing) indicating the current legal status and representation of the Candidate issued by the relevant competent authority in the country of incorporation. If the certificate is issued in a language different than English, a certified translation in the English language shall be required

c) Power of attorney in English (original, certified by a notary and apostilled) of the person(s) signing the request to participate and tender documents. Such document shall be submitted when the request, as well as other tender documents therein, have not been signed by the person(s) representing the company as per the certificate of current corporate registration, but by a duly authorized representative;

d) Written statement by a state authority in the country of incorporation or in the case that there is no such state authority or said authority does not issue such a certificate, a declaration under oath in the presence of a notary that the Candidate:

i) Has not been convicted for anything related to his professional integrity and behaviour.

ii) Has not committed a serious professional misdeed.

iii) Is not in a state of bankruptcy, under liquidation, obligatory management, compromise, or any other similar situation, resulting from a similar procedure and that no procedure has been instigated against the Candidate for declaration in bankruptcy, obligatory management, compromise or any other similar situation or resulting from any other similar procedure.

e) List of sub-contractors if such are envisaged, along with the share of their participation in the execution of the supply.

The Contracting Entity reserves the right to exclude from Invitation any Candidate that it reasonably considers has or may have a conflict of interest with the objectives of the Contracting Entity and/or the IGB project.

Any tender submitted for the award of the object of the present procurement procedure may be rejected where the proportion of the products originating in third countries, as determined in accordance with Council Regulation (EEC) No 2913/92 of 12 October 1992 establishing the Community Customs Code , exceeds 50 % of the total value of the products constituting the tender (DIRECTIVE 2004/17/EC dated 31st March 2004).

Икономическо и финансово състояние:

The Candidate, including each member of a grouping, shall provide as evidence of its sound financial and economic standing the following:

a) A certified copy (by a notary) of the annual financial statement for the last three (3) complete financial years or a copy of the published annual financial statements when their publication is required by the legislation in the country of incorporation.

b) Submission of a written proposal for the funding of the supply until payment by the Contracting Entity is realized.

c) Reference letters from banking institutions concerning Candidate's financial status and capabilities

Технически и професионални способности:

Candidates are requested, as a minimum, to submit the following:

a) Track records for steel line pipe supply (similar quality – EN or equivalent, diameter and wall thicknesses as those under the IGB Project) which shall include the following data:

I. Project name, year and location;

II. Length of the supplied line pipes;

III. Line pipe grade, diameter, wall thickness

Candidates shall submit specific references for the supply of line pipes as those under the IGB Project (same diameter or higher, and specifications as per point II.2.1. above) for the last 5 years with a total length - minimum of 360 km.

b) Production capacity and capability of the Pipe Mill, demonstrating its capability of producing the steel pipe under the present procurement, with the SAWH or SAWL method, and with guarantees for quality, safety and reliability.

In the case of SAWH, the Pipe Mill shall use a steel strip having a width, as a minimum, from 0.8 to 3.0 times wider than the pipe outer diameter.

For the supply of coils or plate, the steelmakers shall have to be of strictly European Union Origin. Candidates must provide a copy of their approved supplier list (coils, coating) and their relevant procedure for approving a new supplier.

c) An estimated time schedule (both production & transport to the construction sites in Bulgaria and Greece) for the realization of the supply from the date of receipt of a written Notice by the Contracting Entity to launch production. Candidates shall list all possible means of transportation, which they plan to be used (train, vessel, truck or a combination of them).

d) Valid Certificate(s) of Accreditation (Licenses) for the production of steel line pipe to recognized standards, especially to the required grade.

e) Valid EN ISO 9000 Certification.

f) Other valid Certificates (e.g. ISO 14000, BS, EN, etc.).

g) Pipe Mill's Quality Manual & Plan where, among others, Candidate's testing & monitoring capability during manufacturing of the pipes, on the welds, dimensional & geometrical tolerances, beveling and pipe coating.

Candidates, who satisfy the above, will be further required during the tendering procedure to prove their capability to produce the supply in accordance with the final Technical Specifications which shall be issued together with the Invitation to Tender.

The requirements for deposits and guarantees will be set out in the tender documents that will be issued to the qualified Candidates, as a result of this call for participation. If invited to tender, Candidates shall be required to submit a Bid Bond to the amount of 250 000 EUR along with their tenders.

The requirements for main financial conditions and payment arrangements will be set out in the tender documents that will be issued to the qualified Candidates, as a result of this call for participation.

If selected from this pre-qualification phase and invited to the next tender phase, Candidate will be required to provide:

A binding declaration that, in case of contract award, Candidate will ensure his best efforts in order to provide to IGB Export Credit Agency support; A declaration that Candidate, in case of contract award, will fulfill all obligations and comply with all procedures (including filling of necessary forms) that may be necessary in order to obtain and maintain ECA support.

Reputable, widely recognized and suitably accredited suppliers are sought.

Candidates may be a physical person, a legal entity or a grouping of them.

If the contract is awarded to a grouping of legal and/or physical persons, a legal form will be required by the grouping.

Legal formation will be required prior to contract signature, but is not required for this call for participation.

The grouping shall submit proof in written form that agreement within the grouping has been reached in relation to participation in the present pre-qualification procedure.

In the case of a grouping, each member of the grouping shall be jointly and severally liable towards the Contracting Entity concerning participation in both the tendering procedure and the contract that may be awarded as a result of the Tender.

If in this pre-qualification phase Candidates submit their expression of interest as a Joint Venture or Consortium of companies, then the partners of the Joint Venture/Consortium cannot be changed by Candidates in the next tender phase.
